The Problem
You have been arrested and the judge has ordered pre-trial detention (Tutuklama). You are wondering if you can pay a certain amount of money ("Bail") to stay at your hotel or fly home while the trial continues, just like in the movies or in your home country.
How the Law Works in Turkey
In the Turkish legal system, "Bail" (Adli Teminat) exists but is very rarely used for foreign tourists. Instead, judges prefer "Judicial Control" (Adli Kontrol). For foreigners, the most common form of this is a Travel Ban (Yurtdışı Çıkış Yasağı). This means you are released from jail but cannot leave Turkey. The judge may also require you to sign in at a local police station once a week.
What the Tourist Should Do
If you are facing detention, your lawyer must immediately propose "Judicial Control" as an alternative to prison. If the judge is worried you will flee the country, your lawyer can offer a "Financial Guarantee" (Teminat) to be deposited into the state treasury as a sign of good faith that you will stay for the trial.
The Risks
The biggest risk for a tourist is being released but forgotten in the system. If a travel ban is placed on your passport and your lawyer does not actively push for the trial to speed up, you could be stuck in Turkey for years, unable to work or return home, even for minor offenses.
LetFix Solution
Being stuck in Turkey with a travel ban is a "silent prison." We specialize in filing emergency appeals to lift travel bans or convert them into financial bail, allowing you to return home while we handle the trial on your behalf.
