An international divorce or separation involving children in Turkey creates one of the most emotionally and legally complex situations a parent can face. Questions of which country courts will decide custody, whether a child can be taken abroad, and how to enforce custody orders across borders are critical. How the Law Works in Turkey
Child custody in Turkey is governed by TMK Articles 182, 335–351. In international cases, the International Private Law (Law No. 5718) and the 1980 Hague Convention on International Child Abduction apply. Turkish courts decide custody based on the best interests of the child (çocuğun üstün yararı). Turkey is a signatory to the Hague Convention, meaning wrongful removal or retention of a child must be remedied through return proceedings. Custody can be sole (tek başına velayet) or, rarely, joint (ortak velayet, recognized since 2017 Constitutional Court decisions).
What the Tourist Should Do
Establish the child habitual residence to determine which country courts have jurisdiction. If filing in Turkey, apply to the Family Court with a detailed custody proposal addressing the child best interests. Request interim custody measures if there is an abduction risk. If the other parent has taken the child to Turkey without consent, file a Hague Convention return application through your country Central Authority. Document your involvement in the child life: school records, medical records, and communication evidence.
The Risks
Taking a child out of Turkey without the other parent consent or court permission can trigger international child abduction proceedings under the Hague Convention. Turkish courts may not recognize foreign custody orders without a formal recognition procedure. Lengthy court proceedings can result in the child becoming habituated to Turkey, weakening return arguments. Parental alienation during proceedings can affect custody outcomes.
