How the Law Works in Turkey

The Turkish criminal process is governed by the Turkish Penal Code (TCK, Law No. 5237) and the Code of Criminal Procedure (CMK, Law No. 5271). The process follows these stages: detention (gözaltı) up to 24 hours (extendable to 4 days for collective crimes), arraignment before a judge (Sulh Ceza Hakimi), indictment by the prosecutor (iddianame), trial before the Criminal Court of First Instance (Asliye Ceza Mahkemesi) for lighter offenses or the Heavy Criminal Court (Ağır Ceza Mahkemesi) for serious crimes. Foreigners have the right to a translator at every stage under Article 202 CMK. Trials can take months or years depending on complexity.

What the Tourist Should Do

Hire a criminal defense lawyer immediately, preferably one experienced with foreign clients. Ensure you have a translator at every official interaction. Ask your lawyer about the possibility of judicial control (adli kontrol) instead of pre-trial detention, which may allow you to leave Turkey with periodic check-ins. If your trial will take a long time, discuss with your lawyer whether you can attend via rogatory (istinabe) from your home country. Keep your embassy informed at all times.

The Risks

The greatest risk is pre-trial detention (tutukluluk), which can last up to 2 years for serious crimes. If a travel ban (yurt dışı çıkış yasağı) is imposed, you cannot leave Turkey until the case concludes, which can severely disrupt your life, career, and finances. Missing a court date after being released on judicial control can result in an arrest warrant and escalated charges. Language barriers during trial can lead to misunderstandings that harm your defense.
