How the Law Works in Turkey
Deportation in Turkey is governed by the Law on Foreigners and International Protection (LFIP, Law No. 6458). Under Article 54 of this law, a foreigner can be deported for reasons including criminal convictions, threats to public order, visa violations, or being deemed a threat to national security. The deportation decision is made by the provincial Directorate of Migration Management (İl Göç İdaresi Müdürlüğü), not by the criminal court. Under Article 53 LFIP, you have the right to appeal a deportation order before an administrative court within 7 days, and deportation is suspended during the appeal process.
What the Tourist Should Do
Request a written copy of the deportation order immediately, as it must be provided in a language you understand per Article 53(3) LFIP. File an appeal within the 7-day window through your lawyer at the administrative court (İdare Mahkemesi). During this time, the deportation cannot be executed. Contact your embassy to inform them of your situation. If you are held in a removal center (Geri Gönderme Merkezi), you have the right to communicate with your lawyer, your embassy, and UNHCR if applicable.
The Risks
Failing to appeal within 7 days means the deportation order becomes final and enforceable. Once deported, you will likely receive an entry ban to Turkey ranging from 1 to 5 years, or even permanently in serious cases. If you voluntarily sign documents agreeing to deportation without understanding them, you lose your right to appeal. Additionally, time spent in a removal center can extend up to 12 months in complex cases, during which your personal belongings and finances may be difficult to manage.
