You arrived at a Turkish airport and customs officers have seized items from your luggage. Perhaps you were carrying prescription medication without proper documentation, antique souvenirs that require export permits, or items you did not realize were restricted in Turkey. How the Law Works in Turkey

Turkish customs law is governed by the Customs Law No. 4458 and the Anti-Smuggling Law No. 5607. Prohibited items include narcotics (penalties under TCK Articles 188-192 carry 10-20 years imprisonment), unlicensed firearms and weapons, counterfeit goods, and certain medications without a prescription. Cultural artifacts and antiques older than 100 years cannot be taken out of Turkey under Law No. 2863 on Cultural and Natural Heritage. Additionally, bringing in more than 10,000 EUR in cash without declaration violates currency regulations. Even seemingly harmless items like certain food products, seeds, or soil may be restricted under agricultural quarantine laws.

What the Tourist Should Do

Always declare items you are unsure about at the red customs channel. If your items are seized, do not argue with customs officers but ask for a written seizure report (el koyma tutanağı). Contact a lawyer immediately, especially if criminal smuggling charges are being considered. For medications, always carry a doctor's prescription translated into English or Turkish. Keep purchase receipts for expensive electronics and jewelry, as customs may suspect commercial import.

The Risks

The most severe risk is being charged under the Anti-Smuggling Law, which carries prison sentences of 1-5 years for basic smuggling and up to 20 years for drug trafficking. Even unintentional violations can result in heavy fines and confiscation of goods. If you are caught with undeclared cultural artifacts, you face both Turkish criminal prosecution and potential international legal issues under UNESCO conventions. Your passport may be confiscated pending investigation, leaving you stranded in Turkey.
