The Problem

You have found your dream property in Turkey — perhaps a seaside apartment in Antalya or a villa in Bodrum — and you are ready to buy. However, Turkish real-estate law contains restrictions and procedures that do not exist in most Western countries. Foreigners can buy property in Turkey, but the process requires military-zone clearance, Tapu (title deed) registration, and compliance with reciprocity rules. Skipping any step can result in void contracts, lost deposits, or even deportation orders if fraud is suspected.

How the Law Works in Turkey

Foreign property ownership is governed by Article 35 of the Land Registry Law (Tapu Kanunu, Law No. 2644, as amended by Law No. 6302 in 2012). Citizens of most countries may purchase up to 30 hectares. Properties inside military zones require clearance from the Turkish General Staff. The Tapu transfer must be completed at the official Land Registry Office (Tapu Müdürlüğü) to be legally valid — private contracts alone do not transfer ownership. Capital-gains tax applies under Income Tax Law (Gelir Vergisi Kanunu, Law No. 193) if the property is sold within five years.

What the Tourist Should Do

Hire a Turkish lawyer before signing any contract. Obtain a Turkish tax ID number (vergi numarası) from the local tax office. Open a Turkish bank account to transfer funds. Request a valuation report from an SPK-licensed appraisal firm. Apply for military clearance at the Land Registry. Complete the Tapu transfer at the Tapu Müdürlüğü with a sworn translator present. Register the property with the municipality for annual property tax.

The Risks

Purchasing without Tapu transfer means you have no legal ownership regardless of what contracts you signed. Some developers sell properties with unpaid debts or construction liens (ipotek) attached. Military-zone rejection after deposit payment can mean months of legal battles to recover funds. Undervaluing the property on Tapu to save on taxes can lead to retroactive penalties and complications if you sell later.
