The Problem

You are renting an apartment in Turkey as a foreign resident or long-term tourist, and your landlord has demanded a massive rent increase, refused to return your deposit, or initiated eviction proceedings without proper notice. Many landlords assume foreign tenants do not know their rights under Turkish law and attempt to exploit this gap. Verbal lease agreements, undocumented payments, and language barriers make these disputes especially difficult for foreigners.

How the Law Works in Turkey

Residential leases are governed by the Turkish Code of Obligations (Türk Borçlar Kanunu, Law No. 6098), Articles 339–356. Annual rent increases are capped by the government (currently limited to CPI-based rates). Landlords cannot evict tenants during a lease term except for specific legal grounds such as personal need (ihtiyaç), which requires a court order. Security deposits cannot exceed three months rent and must be held in a bank escrow account. Leases automatically renew for one-year periods unless the tenant gives 15 days notice before the end of the lease term.

What the Tourist Should Do

Always insist on a written lease agreement in Turkish (with translation). Pay rent via bank transfer and keep receipts. If your landlord demands an illegal rent increase, file a complaint with the Rent Determination Commission (Kira Tespit Komisyonu) or apply to the Civil Court of Peace (Sulh Hukuk Mahkemesi). For deposit disputes, send a notarized warning (ihtar) demanding return within 30 days.

The Risks

Paying rent in cash without receipts makes it nearly impossible to prove payment in court. Verbal agreements are technically valid but extremely hard to enforce. Landlords may change locks illegally — this is a criminal offense (konut dokunulmazlığını ihlal, TCK 116) but recovering possession takes time. Leaving the property without proper notice can result in liability for the remaining lease term.
