The Problem

You want to work as a freelancer or independent contractor in Turkey, but the legal framework does not recognize "freelancer" as a formal employment category. Foreigners cannot simply register as self-employed individuals like Turkish citizens can. Instead, you typically need to establish a company and obtain a work permit through that company, creating a complex legal and tax structure for what might be straightforward freelance work in your home country.

How the Law Works in Turkey

Self-employment for foreigners requires either a work permit through an employer or establishing a Turkish company and obtaining a work permit as a company shareholder/manager. The most common route is forming a single-person Ltd. Şti. under the Turkish Commercial Code (Law No. 6102) and applying for a work permit through the Ministry of Labor. An alternative is the "independent work permit" (bağımsız çalışma izni) under Law No. 6735, Article 10, which requires proving professional qualifications, sufficient financial resources, and a genuine business plan. Freelancers must register with the tax office for income tax and VAT obligations.

Determine the most suitable legal structure: single-person Ltd. Şti. or independent work permit. For the company route: register the company, apply for a work permit as a shareholder, and begin invoicing through the company. For the independent route: prepare a detailed business plan, proof of qualifications, and evidence of financial means. Register with the tax office and start issuing invoices (fatura) for all services. Make quarterly advance tax payments and file annual income tax returns.

The Risks

Working as a freelancer without a work permit is illegal and can result in deportation. Forming a company solely to obtain a work permit without genuine business activity may lead to company dissolution and permit cancellation. Independent work permits are rarely granted and require strong documentation. Tax obligations for self-employed foreigners can be substantial if not properly planned.
