The Problem

You have received a deportation order (sınır dışı etme kararı) from Turkish immigration authorities. This may have resulted from an overstayed visa, an expired residence permit, a criminal conviction, or being deemed a threat to public order. The deportation order feels final and terrifying, but Turkish law provides appeal mechanisms that can suspend or cancel the order if handled correctly and promptly.

How the Law Works in Turkey

Deportation is governed by Articles 52–60 of the Law on Foreigners and International Protection (Law No. 6458). A deportation decision must be notified to the foreigner in writing, in a language they understand. The person has the right to appeal within 7 days of notification to the Administrative Court (İdare Mahkemesi). Filing an appeal automatically suspends the deportation until the court decides (Article 53/3). Administrative detention pending deportation cannot exceed 6 months (extendable to 12 months in exceptional cases). Certain categories of persons cannot be deported: those facing death penalty or torture risk in their home country, and those with serious health conditions.

What the Tourist Should Do

Do not sign any documents you do not understand. Request a translator immediately. Contact your country embassy or consulate. File an appeal with the Administrative Court within 7 days — this is a strict deadline. Request that the court suspend the deportation order pending its decision. If you are placed in a removal center (Geri Gönderme Merkezi), you have the right to legal counsel, communication with your embassy, and medical care.

The Risks

Missing the 7-day appeal deadline means the deportation will proceed. Once deported, you may face a re-entry ban of 1 to 5 years (or indefinitely for security-related deportations). Self-deportation (leaving voluntarily within 15–30 days when offered) avoids a re-entry ban in most cases. Deportation records are shared internationally and may affect visa applications to other countries.
