The Problem

Your Turkish residence permit application has been rejected, and you are now at risk of becoming an overstayer. The rejection notice may be vague, citing "incomplete documents" or "not meeting requirements" without specifying exactly what went wrong. You have limited time to either appeal the decision or leave the country, and making the wrong choice could result in a deportation order and re-entry ban.

How the Law Works in Turkey

Residence permit rejections are governed by Article 21 of Law No. 6458. Common rejection grounds include: insufficient financial means, inadequate health insurance, address in a foreigner-restricted zone, security concerns, or incomplete documentation. Appeals must be filed with the Administrative Court (İdare Mahkemesi) within 60 days of notification. The court can order a stay of execution (yürütmenin durdurulması) to prevent deportation while the appeal is pending. Alternatively, a new application can be submitted from within Turkey if you still hold a valid visa or permit, or from a Turkish consulate abroad.

What the Tourist Should Do

Read the rejection notice carefully and identify the specific reason if stated. Within 10 days of the rejection, you must either file an appeal or make arrangements to leave Turkey to avoid overstay penalties. If you choose to appeal, file with the Administrative Court and simultaneously request a stay of execution. Gather additional documents that address the rejection reason. Consider reapplying in a different province if the rejection was quota-based.

The Risks

Staying in Turkey after rejection without filing an appeal makes you an illegal overstayer, which triggers fines and potential deportation with a re-entry ban. Filing a frivolous appeal without addressing the actual rejection reason wastes time and money. Multiple rejections create a negative pattern in your immigration file that affects future applications. Some rejections based on security grounds cannot be effectively appealed.
